Terms and Conditions for Fly Fishing Holiday Packages
Introduction
These terms and conditions (“Terms”) apply to all bookings made with TheReelTravelCo (“We”, “Us”, or “Our”) for fly fishing holiday packages (“Holiday Packages”). By making a booking, You agree to be bound by these Terms. Please read them carefully before booking.
The Holiday Contract
2.1 Booking and Contract Formation
A contract between us and you will exist once we receive your deposit and completed booking form, at which point we will issue a confirmation invoice. The ‘lead name’ on the booking guarantees that they have the authority to accept these Terms on behalf of all members of the party. This contract is governed by Scottish law, and any disputes will be subject to the exclusive jurisdiction of the Scottish courts. Nothing in these Terms affects your rights under the Consumer Rights Act 2015.
2.2 Accuracy of Booking Details
Upon receiving our confirmation invoice, it is essential that you verify that all details are correct, including the spelling of all names and travel dates. If a mistake is identified, you must notify Us immediately. Failure to do so may result in additional charges or the need to rebook.
2.3 Changes to the Booking
If you wish to change any aspect of your booking (e.g., date, itinerary, or passenger details), you may incur amendment fees. These fees will depend on the nature of the changes and third-party suppliers involved. If you cancel or amend your booking after confirmation, cancellation charges may apply as outlined below.
Price and Inclusions
3.1 Package Price
The price of the Holiday Package excludes international flights, travel insurance, personal expenses, and any services not explicitly mentioned in the itinerary. The price includes accommodation, ground transportation (as per the itinerary), meals as described, fly fishing guides, and any additional services listed in the booking confirmation.
3.2 Room Allocation and Supplements
Unless specified otherwise, the Holiday Package price is based on a twin room basis. If you are a solo traveller and wish to have a twin room for yourself, we offer an Under Occupancy Supplement, which guarantees you a room to yourself. Alternatively, as a solo traveller, you may book a “request to share” room at no extra charge, subject to availability.
Booking and Payment Terms
4.1 Booking Process
To book a Holiday Package, you must complete a booking form either online or directly with Us. After receiving the deposit and completed form, we will issue a Booking Confirmation. A contract will only be formed once you receive this confirmation and the deposit has been paid.
4.2 Payment Schedule
A non-refundable deposit of [50%] is required at the time of booking. The balance must be paid in full no later than [90 days] before departure. If the balance is not paid by this date, your booking may be cancelled, and the deposit forfeited.
4.3 Payment Methods
We accept payments by all acceptable payment methods: credit card, bank transfer, cash and cheque. All payments are to be made in GBP (£) unless otherwise agreed.
Cancellations and Amendments
5.1 Cancellation by the Customer
You may cancel your booking at any time. The following cancellation charges apply:
• More than 90 days before departure: Retention of the deposit or 50% of the total price, whichever is greater.
• Less than 90 days before departure: 100% of the total price.
If you cancel the booking, the deposit is non-refundable. If you cancel after full payment has been made, you will be entitled to a refund minus the cancellation charges.
As per the Consumer Contracts (Information, Cancellation, and Additional Charges) Regulations 2013, you have the right to cancel your booking within 14 days of booking without penalty, provided your package has not yet started. However, if the package begins within this 14-day period, you agree to waive this right.In line with the Package Travel and Linked Travel Arrangements Regulations 2018, if extraordinary and unavoidable circumstances occur at your destination that significantly affect your trip (such as natural disasters or political unrest), you may cancel without paying a cancellation fee and receive a full refund. In such cases, you will not incur cancellation charges.
5.2 Amendment Fees
If you wish to amend any part of your booking (such as dates, location, or guest details), an amendment fee may apply. Depending on the third-party suppliers involved (e.g., accommodation), changes may also incur additional charges, which will be communicated to you at the time of the amendment request.
5.3 Cancellation by Us
We reserve the right to cancel the booking if:
I) II) The minimum number of participants for a group tour is not met.
Force majeure events (e.g., natural disasters, political instability, etc.) prevent the trip from taking place.
In such cases, you will be given the option to choose an alternative holiday or receive a full refund of payments made, excluding the deposit. We are not liable for any other costs or expenses you may have incurred (e.g., flights, visas).
Price Changes and Adjustments
6.1 Price Changes for Unconfirmed and Confirmed Bookings
We reserve the right to amend the price of unsold trips at any time and correct errors in the prices of confirmed bookings. We may also increase the price of confirmed bookings in the following circumstances:
I) Changes in the cost of fuel or other power sources affecting transport providers.
II) Increases in taxes, tourist taxes, or embarkation/disembarkation fees imposed by third parties.
II) Changes in relevant exchange rates that affect the cost of the trip.
6.2 Impact of Price Changes
If the price of your confirmed booking increases by more than 8% due to any of the above reasons (excluding insurance premiums and additional services), you will have the option to:
Accept a change to another trip (if available), or
Cancel the booking and receive a full refund of all monies paid, except for insurance premiums, amendment fees, and additional services.
You must exercise this right within 7 days of receiving the price increase notification. We will consider providing a refund for the insurance premiums if you are unable to transfer or reuse the policy.
6.3 Price Decreases
If the price of your confirmed booking decreases due to the changes mentioned above, a refund will be made to you, minus an administrative fee of £50.00. Some price changes may have no impact on the overall cost if travel arrangements are contracted in a different currency or protected by contracts in place.
6.4 No Changes Within 20 Days of Departure
There will be no price changes made within 20 days of departure, nor will refunds be issued during this period.
Documentation and Travel Requirements
7.1 Passport, Visas, and Permits
We strongly recommend that you check the specific entry requirements for your destination well in advance of travel, including passport, visa, and any other necessary documentation. While we provide general guidance on documentation requirements, it remains your responsibility to ensure that all travel documents are valid and in order. If you are refused entry due to invalid or incomplete documentation, we will not be liable for any resulting costs or inconvenience. We are not responsible for any refusal of entry by immigration authorities, and any costs incurred as a result of this will be at your own expense.
Standards and Suitability of Holidays
8.1 Holiday Standards
Standards of accommodation, transport, and facilities may vary depending on the destination and type of tour booked. While we strive to ensure that all our tours meet a high standard of quality,you should be aware that the level of service or comfort in remote or rural locations may not match more conventional destinations. If you have any doubts regarding the suitability of a tour, please contact one of our travel consultants who will provide you with additional details to help you make an informed decision.
8.2 Weather and Environmental Conditions
We cannot be held responsible for any inconvenience, disruption, or costs arising from adverse weather conditions or unseasonal effects on fishing or shooting seasons. Weather can significantly impact fishing and other activities, and delays or cancellations caused by bad weather will be handled professionally, but no compensation will be provided for events outside of our control.
8.3. Local Safety Standards
When booking with us, you acknowledge that safety standards abroad may not always match those in the UK. Despite this we will take all reasonable steps to ensure facilities and services provided meet essential safety standards, even if these differ from UK requirements such as lack of lighting, no flotation devices provided, no water depth markings, uneven ground or dangerous swamp areas with no signage. It is your responsibility to assess the suitability of the destination before completing your booking.
8.3. Disabilities & Required Fitness Levels
We are committed to adhering to the Equality Act 2010 and will take reasonable steps to accommodate any specific needs or requirements you may have. If you or anyone in your group has a health condition or disability that might impact your booking, please let us know the full details before completing your reservation. This will allow us to assess the suitability of the arrangements and provide guidance accordingly.
Some of the fishing we offer take place in remote areas without immediate access to medical facilities, and the risk of injury may be higher due to factors such as uneven terrain, swamp or marsh like areas, changing weather conditions, water levels, and potential wildlife interactions. We will inform you ahead of time if your selected activities include physical demands or take place in isolated locations. We highly recommend consulting your doctor to confirm that these activities are suitable for you before finalizing your booking.
Liability
11.1 Our Liability
We are responsible for providing the services outlined in the Holiday Package with reasonable care and skill. However, we are not liable for any injuries, damages, losses, expenses or death caused by:
I) Acts of nature such as natural disasters such as floods, earthquakes, or weather conditions which make it impossible to travel safely to a destination, acts of terrorism (and threat thereof), labour strikes, or any unavoidable problems out with our control. II)
Third-party suppliers (e.g., accommodations, transportation providers).
III) The Customer’s negligence or failure to follow instructions.
12. Force Majeure
Neither party will be held responsible for failure to fulfil contractual obligations if such failure is due to a force majeure event, including but not limited to natural disasters, political unrest, pandemics, strikes, travel restrictions, or other unforeseen events beyond reasonable control. In such cases, we will notify you as soon as possible and provide reasonable alternatives if available. In accordance with the Package Travel and Linked Travel Arrangements Regulations 2018, if unavoidable and extraordinary circumstances at the destination or in its immediate vicinity significantly affect the performance of the Holiday Package or the transport arrangements, you may cancel the package and receive a full refund before the start of the holiday. If the force majeure event results in significant changes to the Holiday Package or its cancellation after the start of the package, you will be entitled to a full refund or the option to book an alternative trip, where available, in accordance with the Package Travel and Linked Travel Arrangements Regulations 2018.
13. Financial Protection
As required by the Package Travel and Linked Travel Arrangements Regulations 2018, Your payments for the Holiday Package are financially protected which means that in the unlikely event of our insolvency, you are entitled to a refund or repatriation as per the regulations.
14. Complaints
If you are dissatisfied with any aspect of your Holiday Package, you must notify Us or the relevant service provider as soon as practicable, but no later than 24 hours after the issue arises. We will work to resolve any issues promptly.
15. Data Protection
We process personal data in accordance with the Data Protection Act 2018 and GDPR. By booking a Holiday Package, you consent to the collection and processing of your personal data as necessary to fulfil our obligations. You can find more information about how we handle your data in our Privacy Policy. You also have the right to access, rectify, erase, and restrict the processing of your personal data, in line with your rights under GDPR.
16. Governing Law and Dispute Resolution
These Terms are governed by Scottish law. Any disputes arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the Scottish courts. Nothing in these Terms affects your rights under UK consumer law, including the Consumer Rights Act 2015.
17. Entire Agreement
These Terms and Conditions, together with the Booking Confirmation and any other relevant documents, constitute the entire agreement between us and you. Any amendments or variations to these Terms must be made in writing and agreed upon by both parties. Any emails or online communications can be considered valid amendments if agreed in writing by both parties.
18. Travel to the Destination
18.1 Responsibility for International Flights and Travel
TheReelTravelCo does not arrange or book international flights to or from the holiday destination. We can advise on flight arrangements based on our experience, but we will not be held responsible for the suitability or timing of any flight bookings. You are solely responsible for arranging your own flights to the destination and ensuring that you arrive at the agreed-upon pick-up or meeting point on time.
Our responsibility for providing the Holiday Package begins from the agreed-upon pick-up point (as outlined in the itinerary). We are not liable for any delays, cancellations, or failure to arrive at the destination due to flight issues, missed connections, or travel-related problems outside of our control.If you do not make it to the holiday destination because of any issues with your international flights or travel arrangements, we will not be held responsible for any additional costs or inconvenience incurred. It is your responsibility to ensure timely arrival at the agreed meeting point for the start of the Holiday Package. Similarly, if you miss the scheduled pick-up or dropoff, we are not liable for any additional transport or accommodation costs.
